Notification Appointing Special Officers For Municipal Corporations- GO MS No 425 dt 29.09.2010

                                             NOTIFICATION

Whereas, the term of the Members of 11 Municipal Corporations in the State of Andhra Pradesh is going to expire by 29.10.2010 except Vijayawada Municipal Corporation Council, whose term is going to expire by 6.10.2010, as per sub-section (1) of Section 6 of the Greater Hyderabad Municipal Corporation Act, 1955 and clause (a) of sub-section (1) of Section 7 of Andhra Pradesh Municipal Corporations Act, 1994.

And whereas, according to sub-section (1) of Section 7 of the Greater Hyderabad Municipal Corporations
Act, 1955 and sub-section (2) of Section 7 of Andhra Pradesh Municipal Corporations Act, 1994, ordinary vacancies in the office of the members shall be filled at Ordinary Elections which shall be completed before the expiry of the term of office of the members.

And whereas, Government is of the opinion that it is not possible to hold ordinary election to the said Municipal Corporations in accordance with the provisions of these Acts due to the following reasons:

(i) Re-division of Municipal Corporations into wards as per the re-fixation of strength as per the Andhra Pradesh Municipal Corporations (Fixation of Strength of elected members) Rules, 2005, could not be completed due to ongoing Census Operations; and

(ii) Identification of Backward Class voters as per the guidelines issued in G.O.Ms.No.444, MA, date: 4.10.2001 could not be completed in view of directions/observations of Hon’ble High Court of A.P., vide orders, dated: 29.7.2009 in W.P.No. 13518/2009 and batch cases and the Hon’ble Supreme Court of India, vide orders dated: 21.8.2009 in SLP No. 19697-19699/09 and orders dated: 11.5.2010 in W.P. (civil) No. 356/94 and W.P (c) Nos. 245/95 and 517/2005

Now, therefore, in exercise of the powers conferred by sub-section (1) of Section 70-G of the Greater Hyderabad Municipal Corporation Act, 1955 (Andhra Pradesh Act No.2 of 1955) and sub-section (1) of Section 9 of Vijayawada Municipal Corporation Act, 1981, and in modification of the orders issued in G.O.Ms.No. 140, MA&UD (Elec-II) Department, dated. 29.03.2010, the Government of Andhra Pradesh hereby appoint the officers appended to this notification as Special Officers to the Municipal Corporations noted against them with effect from the dates indicated therein to exercise the powers, perform the duties and discharge the functions of the Corporations and the Standing Committees for a period of 6 (six) months or until the elected members come into office whichever is earlier.
